Terms of Access

When these Terms apply

These are the Terms of Access (the Terms) which apply to all Māori Television websites (the Site, the Sites or mobile applications). If you use the Sites you acknowledge that you have read and understood the Terms and agree to be bound by them. “Māori Television” includes but is not limited to Māori Television Service and all its brands and operating companies.

Māori Television may change the Terms from time to time. Using any Site after the Terms have changed means you accept the changed Terms. New Zealand law governs the Site and the Site does not purport to comply with any laws other than those of New Zealand.

 

Content: using our content and submitting content

All content on the Site is protected by intellectual property rights (copyrights, trade marks or other rights and laws). You need Māori Television’s prior written consent to deal with any of the Site content.

You must obtain Māori Television’s permission before linking to the Site. Māori Television takes no responsibility for other sites which may be linked to the Site.

If you submit any content to the Site you must comply with the Rules for when you give us content. There may be other specific rules that apply to particular forums or parts of the Site. Those specific rules will apply if there is any inconsistency with these Terms.

 

Your responsibilities

You use the Site at your own risk. The Site may not always be available, for example, during maintenance or repair. We endeavour to make sure that the content in the Site is correct, but it is provided "as is" and "as available", without warranties of any kind (either express or implied).

You agree that Māori Television will not be liable for your reliance on any information on the Site (even if negligently provided). You also agree that Māori Television will not be liable for any damages (direct, incidental, special, consequential, indirect or punitive) resulting from the use of, or inability to use, the Site. You agree that if we are held responsible for any damage or loss, Māori Television’s total liability to you for all damages, losses, and causes of action (whether in contract, tort - including but not limited to negligence - or otherwise) will not exceed the amount paid by you, if any, for accessing the Site.

If you are a business using the Site, then you agree that the New Zealand Consumer Guarantees Act 1993 does not apply to your use of the Site.

If you breach the Terms you agree to keep Māori Television fully indemnified against all losses, expenses, damages, claims and other costs incurred or made against Māori Television as a result of your breach. We may also suspend your access to the Sites or suspend any account you have with us which you use to post content. We may also inform third parties about your behaviour for serious breaches of these Terms where we can do so at law.

 

Our responsibilities

While we endeavour to keep information and materials on the Site secure and confidential, we are not responsible for any breach of security which is out of our control. We do not warrant that the Site is completely secure.

 

Your privacy

 

Rules for when you give us content

These rules apply whenever you give Māori Television content. Whether you send us video footage for a news story, submit content for a competition, post in one of our online forums (including on our Facebook page) or if you just send us a video of your mates, you agree to the following:

All content must be yours. You must not have copied someone else’s work and you must have the right to make the content available to us without asking anyone else’s permission. To the extent permitted by law, you waive all moral rights in the content.

By giving us the content you grant to us all right to use, reproduce, broadcast, replay, edit, adapt and modify the content. We do not have to use your content and we may take down any content at any time. Once you send us the content, it becomes ours. Unless expressly agreed with you, we will not pay you when we use the content.

You should make sure your content is not defamatory, does not copy or use anyone else’s content without permission and does not breach the law. Keep your content respectful. Don’t include any objectionable, obscene, profane or sexually explicit content. You agree that you will be responsible, indemnify and hold us harmless from any costs, expenses and fees (including legal fees) we may incur as a result of you breaking these rules.

We may contact you if you submit any content to us.

Don’t put yourself or anyone else in danger when gathering content. We don’t support breaking laws to get content.

Don’t allow your personal details or anyone else’s personal details to be made public in your content.

If you are under 18, we may request your parent or guardian give their permission to you providing the content.

 

Changes to Policy

We reserve the right to change this policy at any time by notifying users of the existence of a revised policy by updating the "last updated" date at the bottom of this page. By continuing to use the website, you agree to be bound by the amended policy. You should check from time to time to see if the policy has changed or not.
